RIGHT OF WITHDRAWAL (if you have changed your mind)

You have the right to withdraw from the contract, without stating reasons, within 14 days. The withdrawal period will expire after 14 days from the day you acquired the physical possession of the goods or the physical possession of the last good in case of necessity provvedessimo to send separate of the assets the subject of purchase with a single order. To exercise the right of withdrawal, you must inform us of your decision to withdraw from this contract by an unequivocal statement (e.g. a letter sent by mail or e-mail).

EFFECTS OF WITHDRAWAL

If you opt-out from this contract, we shall reimburse to you all payments which you made on our behalf, including the costs of delivery (with the exception of the supplementary costs resulting from your choice of a type of delivery other than the least expensive type of standard delivery offered by us), without undue delay and in any event not later than 14 days from the day on which we are informed of your decision to withdraw from this contract. The direct cost of returning the goods shall be at your expense. Such refunds will be made using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any case, you will not have to incur any costs as a result of such reimbursement. The refund may be suspended until receipt of the goods must be returned in original packaging and in perfect condition as they were received.

THE LEGISLATION IN DETAIL WITH ALL THE INSTRUCTIONS:

The legal warranty

Pursuant to Legislative Decree 206/2005 (“Consumer Code”) all products for sale on this site are covered by the Legal Warranty of 24 months.

According to the Legal Guarantee of 24 months Sistemarredi Anna Cavezzali is liable to the consumer (the person who is acting for purposes which are outside his trade, business, craft or profession) for conformity defects not evident at the time of purchase.

The lack of conformity exists when the product is not suitable for the use to which it should serve, usually, does not conform to the description or does not possess the qualities promised by the seller, does not offer the quality and performance which are normal in goods of the same type, not is suitable for the particular use desired by the consumer if made known to the seller at the time of purchase and accepted by the seller (art. 129 of the Consumer Code).

The lack of conformity which becomes apparent within 24 months from the date of purchase of the item must be reported within 2 months from the date of discovery of the defect.

Unless there is proof to the contrary, it is assumed that the conformity defects that occur within 6 months from delivery of the goods already existed on that date. In case of lack of conformity the consumer has the right to restore, without charge, the conformity of goods by repair or replacement (art. 130 of the Consumer Code). The consumer can ask the seller to replace it, without charge of expenditure. Substitutions must be made within a reasonable time after the request of the Consumer; the average time of delivery to the Consumer of the product is 24 days. If, within 60 days of the Sistemarredi Anna Cavezzali was not able to send the replacement, the consumer may request one of the alternative remedies (termination of the contract, price reduction).

Mode and time of exercise of the Legal Guarantee The Customer shall:

send the written communication to Sistemarredi Anna Cavezzali, or contact Sistemarredi Anna Cavezzali phone number 0434 241 455 indicating the defect in the product;

wait for communication of the return authorization on the part of Sistemarredi Anna Cavezzali ;

prepare the product for shipment packing it / them accurately and including all accessories, the instruction manual and everything contained originally in the packaging of the product;

The carrier will contact the Customer to arrange collection of the product (the unavailability of telephone Customer will delay the withdrawal of the product).

The rights of the customer private

The Consumer Code (arts. 128-135) provides a Legal Guarantee of 24 months in the sales of consumer goods between dealers and consumers. Sistemarredi Anna Cavezzali is responsible vis-à-vis consumers (natural persons acting for purposes extraneous to the entrepreneurial, commercial, artisan or professional) of conformity defects for all products sold in its stores and on its official website. The Legal Warranty of 24 months does not apply to products purchased with invoice and VAT by enterprises and professionals.

The lack of conformity exists when the product is:

it is not suitable for the use for which it shall serve, normally,
does not conform to the description or does not possess the qualities presented by the seller,

it does not offer the quality and performance which are normal in goods of the same type,

it is not suitable for the particular use desired by the consumer if made known to the seller at the time of purchase and accepted by the seller.

The lack of conformity which becomes apparent within 24 months from the date of purchase of the property must be reported by the consumer within 2 months from the date of discovery of the defect.

Unless there is proof to the contrary, it is assumed that the conformity defects that occur within 6 months from delivery of the goods already existed on that date.

To report any defect in the product purchased at Sistemarredi Anna Cavezzali, the consumer must present the invoice or in the absence thereof, the receipt of the payment done at the time of purchase (the cutting of the check, coupon, credit card, the receipt of the atm, the mayl of Paypal with the identification codes) or in the absence of these, the packaging of the product .

In the case of lack of conformity duly reported within the deadline, the consumer has the right:

primarily, the replacement of the asset. In the alternative (when the first remedy has not been made within a reasonable time, or replacement have caused significant inconvenience to the consumer), to request a reduction of price or termination of the contract.

Substitutions must be made within a reasonable time after the request of the consumer.

The average time of delivery to the Consumer Sistemarredi Anna Cavezzali of the replacement product is 24 days. If, within 60 days of the Sistemarredi Anna Cavezzali was not able to send the replacement product, the consumer may request one of the alternative remedies (termination of the contract, price reduction).

Sistemarredi Anna Cavezzali will:

examine the product to verify whether to proceed with the replacement or if there are obvious causes of exclusion of the Legal Guarantee (e.g. expiration of the term of coverage, the presence of accidental damage or procured by the consumer);

replace the same product;

Sistemarredi Anna Cavezzali will notify the consumer by e-mail or with a phone call when the product is ready for pickup.

The right of withdrawal

The sales of products via the Internet are regulated in articles 50 to 68 ("distance contracts") of Legislative Decree 206/2005 (the Consumer Code). This legislation provides for the consumer the right to withdraw from the contract or the contract proposals, guaranteeing the right to return the product purchased and to obtain reimbursement of expenses incurred. The right of withdrawal does not apply to the particular products out of production or hard to find in the market (reported previously in the process of estimating).

The right of withdrawal can not be exercised if the product is not intact, namely:

in the absence of the original packaging

in the absence of integral elements of the product (accessories, hardware, manuals, etc.);

for damage to the product.

The right of withdrawal is reserved exclusively for consumers (individuals who purchase goods for purposes not related to his professional activity, trade or business), and may not be exercised by legal persons and physical persons who act for scopes of a professional activity.

The costs of returning the product are borne by the Customer.

The timing and procedures for the exercise of the right of withdrawal

To exercise the right of withdrawal, you must inform Sistemarredi Anna Cavezzali , within 14 working days from receipt of the goods, the intention to withdraw from the contract by using the module or submitting any other explicit communication, using the following methods:

within 14 days from the sending of the notice of withdrawal (art. 57 of legislative decree 206/2005)the Client will send Sistemarredi Anna Cavezzali - Via Cividale 41 - 33084 Cordenons (PN), the product carefully packed in original packaging and complete with all accessories, instruction manuals and everything in origin content.

Method and timing of reimbursement to the Customer of the cost of the product and the shipping costs

Sistemarredi Anna Cavezzali will refund within 14 days of the exercise of the right of withdrawal by the Customer. The refund could be withheld for 14 days only until She has demonstrated to have sent back the goods or until we have not received, whichever situation occurs first.. In the case where the product has already been delivered to the Customer, Sistemarredi Anna Cavezzali will refund as a result of the future return of the product and verification of the integrity of the same.

For purchases made with one of the following methods of payment:

Credit card, Bank transfer

Sistemarredi Anna Cavezzali will process the refund by bank transfer, the customer will provide the bank coordinates on which obtain reimbursement (account holder name, bank address and IBAN).

For purchases made through PayPal, the refund will be made by crediting the account of the Customer.

Please note that the cost of returning goods is the responsibility of the Customer.

The customer is only liable for any diminished value of the goods resulting from the handling of goods different from that to establish their nature, characteristics and functioning of the same.

In the case of assets dormer suffered a handling other than what is necessary to establish the nature, characteristics, and operation, the customer is not precluded the possibility of exercising the right of withdrawal. The Customer shall be solely responsible for the decrease in the value of the goods.

Complaints

Any claim relating to the delivery of the products and their characteristics at the time of delivery must be reported to Sistemarredi Anna Cavezzali with one of the following ways:

Products damaged or mismatch of packages:

any external damage or the mismatch in the number of packages must be immediately notified to the Courier by the application of a reserve of writing on proof of delivery with specific exterior damage or the number of missing packages. It is understood that, once signed the delivery document without any claim, the Customer may not raise any objection with reference to the external characteristics of delivered goods. Notification of acceptance with reserve, it should also be denounced Sistemarredi Anna Cavezzali within 8 days through the means of communication listed above. Any damage which is not apparent and incurred subsequently to the delivery of the Products shall be reported to Sistemarredi Anna Cavezzali, within 8 days from their discovery.

Delivery delays: complaints may be submitted within 6 days from the failure to receive with respect to the expected date of delivery or, if the product has been delivered, from the day of delivery.

All complaints must contain the description of their object and the grounds on which they are based.

In the event that deliveries are not made within the time and in the prescribed manner, Sistemarredi Anna Cavezzali , made the necessary feedback, I will refund entirely the corresponding surcharge delivery through bank transfer.

Sistemarredi Anna Cavezzali not use dispute settlement mechanism of the organs of-court settlement provided for by art. 19 of decree D. Lgs. 70/2003; therefore, any dispute will be competence of the ordinary Judge.
